1. Acceptance of Terms

By accessing and using the SwitchTobacco website (the "Site"), you accept and agree to be bound by the terms and provisions of this agreement. In addition, when using this Site's particular services, you shall be subject to any posted guidelines or rules applicable to such services.

2. Eligibility

You must be at least 18 years of age (or the minimum legal age in your jurisdiction) to purchase any products from SwitchTobacco. By placing an order on our Site, you represent that you are of legal age to purchase tobacco and vaping products in your jurisdiction.

3. Products and Pricing

All products are subject to availability. We reserve the right to limit the quantities of products that we offer. All descriptions of products and product pricing are subject to change at any time without notice, at our sole discretion.

We have made every effort to display as accurately as possible the colors and images of our products. We cannot guarantee that your computer monitor's display of any color will be accurate.

4. Orders and Payment

When you place an order through our Site, you are offering to purchase the products subject to these Terms. We reserve the right to refuse or cancel any order for any reason at any time.

We may require additional verification or information before accepting any order. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

5. Shipping and Delivery

We will arrange for shipment of the products to you. Please check the individual product page for specific delivery options. You will pay all shipping and handling charges unless otherwise specified.

Title and risk of loss for all products ordered by you shall pass to you upon our delivery to the carrier.

6. Returns and Refunds

Due to the nature of our products, we do not accept returns or offer refunds for vaping devices, e-liquids, or any consumable products that have been opened or used.

If you receive a defective product, please contact our customer service within 7 days of delivery. We may, at our discretion, replace the defective product or issue a store credit.

7. Account Registration

To access some features of the Site, you may be required to register for an account. When you register, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account.

You must notify us immediately of any breach of security or unauthorized use of your account. We will not be liable for any losses caused by any unauthorized use of your account.

8. Intellectual Property

The Site and its original content, features, and functionality are owned by SwitchTobacco and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You agree to defend, indemnify, and hold harmless SwitchTobacco and its subsidiaries, agents, licensors, managers, and other affiliated companies, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses arising from:

• Your violation of any term of these Terms
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right
• Any claim that your use of the Site caused damage to a third party

13. Changes to Terms
